Our general conditions of sale

So-Lunettes is a limited liability company (SARL) whose activity is the retail sale of optical and eyewear products (optician). The company is run by a state-certified optician.

These conditions of sale are concluded on the one hand by the company So-Lunettes (OR ENAÏM) with a capital of 10,000 euros whose head office is located at 16 boulevard Victor in Paris 15th, registered in the Trade and Companies Register of Paris under the number 789 520 772 hereinafter referred to as So-Lunettes and on the other hand, by any natural or legal person wishing to make a purchase via the So-Lunettes website hereinafter referred to as "the buyer".

Article 1 - Object

The present conditions of sale aim at defining the contractual relations between So-Lunettes and the purchaser and the conditions applicable to any purchase carried out by the means of the commercial site of So-Lunettes, that the purchaser is professional or consumer.

The acquisition of a good or a service through the present site implies an acceptance without reserve by the buyer of the present conditions of sale.

These conditions of sale will prevail on all other general or particular conditions not expressly approved by So-Lunettes.

So-Lunettes reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the buyer.

Article 2 - Characteristics of the goods and services offered

The products and services offered are those listed in the catalog published on the site of So-Lunettes.

These products and services are offered within the limits of available stocks.

Each product is accompanied by a description established by the supplier; for some of them, bearing the mention DF, the purchaser can have access to the documentation of the supplier.

The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors.

Article 3 - Prices

The prices appearing in the catalog are prices including all taxes in euro taking into account the VAT applicable to the day of the order; any change of the rate could be reflected on the price of the products or the services.

So-Lunettes reserves to modify its prices at any time, being however understood that the price appearing in the catalog the day of the order will be the only applicable one to the purchaser.

The prices indicated do not include the costs of order processing, transport and delivery as long as they take place in the geographical areas provided below.

Article 4 - Geographical area

The online sale of products and services presented in the site is reserved for buyers whose delivery area is proposed on the site.

Article 5 - Orders

The buyer, who wishes to buy a product or a service must

- Fill in the identification form on which he will indicate all the requested details or give his customer number if he has one ;

- fill in the online order form giving all the references of the chosen products or services ;

- validate the order after having checked it ;

- make the payment in the conditions provided ;

- confirm the order and payment.

The confirmation of the order implies acceptance of these terms of sale, the recognition of having perfect knowledge and waiver of its own conditions of purchase or other conditions.

All the data provided and the recorded confirmation will be worth proof of the transaction. The confirmation will be worth signature and acceptance of the operations carried out.

The seller will communicate by e-mail confirmation of the order recorded.

Article 6 - Withdrawal

Buyers have a thirty-day withdrawal period from the delivery of their order to return the product to the seller for exchange or refund without penalty. In order to be treated, the returns must be delivered to the headquarters. So-Lunettes can edit a return form for its customer, but is not responsible for the delivery of the package.

Returns are not accepted for products on sale or in promotions, products having been bought on the occasion of an exceptional offer from the seller. These products cannot be exchanged, credited or refunded.

Finally, items purchased with corrective lenses adapted to the customer's vision are also non-refundable. So-Lunettes will not refund the frame or the corrective lenses.

Article 7 - Terms of payment

The price is due at the time of order.

Payments will be made by credit card or PayPal; they will be made through the secure system that uses SSL (Secure Socket Layer) so that the information transmitted is encrypted by software and that no third party can read it during transport on the network.

The buyer will be sent an invoice showing the VAT.

Article 8 - Deliveries

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.

The risks are the responsibility of the purchaser as from the moment when the products left the buildings of So-Lunettes. In the event of damage during transport, the justified protest must be formulated near the conveyor as well as with So-Lunettes, within three days as from the delivery.

When an order is placed on the site, according to the purchased object, several possibilities are presented :

Products with a small icon marked "24" are shipped from the warehouse within 24 hours. The product is received by the customer within 48 to 72 hours (in working days). (The delay concerns metropolitan France. For other countries, please refer to the delivery times provided by La Poste).

The other products are shipped within 4 to 7 days (in working days). It will thus be necessary to deduct from the time, Saturdays, Sundays and holidays. Of course, this delay only concerns glasses without corrective lenses and sunglasses. For a purchase of glasses with corrective lenses, the delivery time is extended from five to ten working days.

As soon as the product is shipped from the warehouse, the customer receives an email with a tracking number. Once this email is received, the package is usually delivered to the customer within 48 hours (in working days. The time limit concerns metropolitan France. For other countries, please refer to the delivery times provided by La Poste).

It may happen that for obvious logistical reasons, some models listed on the site are in production or are no longer available for sale. Once the error is noticed, (in the case of a model no longer available for sale) the model is immediately removed from the site.

When this happens, the customer is contacted within 48 hours by the Customer Service by email and / or phone.

According to the state of the order, So Lunettes proposes to the customer several alternatives.

• If the model is in production, the customer can choose to wait until it is available again.

• If the model is in production or out of stock, the customer can exchange it with another available model, with the same price; or, an available model with a higher price. The difference is offered by So-Lunettes as a commercial gesture (the commercial gesture is indicated by the Customer Service).

• If the model is in production or out of stock, the customer can request a refund.

Article 9 - Guarantee

All products supplied by the seller benefit from the legal guarantee provided by articles 1641 and following of the Civil Code.

In case of non conformity of a product sold, it can be returned to the seller who will take it back, exchange it or refund it.

Article 10 - Refusal of order

So-Lunettes reserves the right to remove any product from the site, and/or to replace or modify any content or information on this site.

Although we strive to always process our customers' orders, there may be exceptional events in which we will be forced to accept an order.

Article 11 - Liability

The seller, in the process of selling online, is only bound by an obligation of means ; its responsibility cannot be engaged for any damage resulting from the use of the Internet network such as data loss, intrusion, virus, break in service, or other involuntary problems.

Article 12 - Intellectual property

All the elements of the So-Lunettes website are and remain the exclusive intellectual property of So-Lunettes.

Nobody is authorized to reproduce, exploit, rebroadcast, or use in any way whatsoever, even partially, elements of the site whether they are software, visual or sound.

Any simple link or hypertext link is strictly forbidden without the express written consent of So-Lunettes.

Article 13 - Personal data

In accordance with the law relating to data processing, the files and freedoms of January 6, 1978, the information in personal matter relating to the purchasers could be the subject of an automated treatment.

So-Lunettes reserves the right to collect information on the purchasers including by using cookies, and, if it wishes it, to transmit to commercial partners the collected information.

The buyers can object to the disclosure of their details by notifying So-Lunettes. In the same way, the users have a right of access and of correction of the data concerning them, in accordance with the law of January 6, 1978.

Article 14 - Archiving - Proof

So-Lunettes will file the purchase orders and invoices on a reliable and durable medium constituting a true copy in accordance with the provisions of article 1348 of the Civil Code.

The computerized records of So-Lunettes will be considered by the parties as proof of communications, orders, payments and transactions between the parties.

Article 15 - Settlement of disputes

The present conditions of sale on line are subjected to the French law.

In the event of litigation, jurisdiction is attributed to the competent courts of Paris, notwithstanding multiple defendants or appeal in guarantee.
